Terms of Service
These Terms of Service ("Terms") govern your access to and use of RadSim, a software service operated by Rad Consultants, LLC ("we," "us," "RadSim"). By creating an account or using the service, you agree to these Terms.
1. The service
RadSim is an AI-powered training simulation platform. We provide software tools that generate practice scenarios from publicly available company information and enable employees to engage in simulated conversations scored by AI. We do not provide training content, coaching, HR advice, or employment services of any kind.
2. Free trial
New accounts on the Starter and Business plans receive a 14-day free trial. No credit card is required to start. At the end of the trial period, you will be contacted by our team about continuing on a paid plan. We will not automatically charge you — billing during the current phase is handled manually via invoice.
3. Subscriptions and billing
Paid subscriptions are billed monthly or annually at the rates listed on our pricing page at the time of subscription. Pricing is in USD. We reserve the right to change pricing with at least 30 days notice to active subscribers.
Manual invoicing: During the current billing phase, invoices are sent by email and payable within 14 days. Accounts with overdue invoices beyond 30 days may be suspended.
Annual plans: If you choose annual billing, you are committing to 12 months of service. Refunds for unused months are at our discretion.
4. Acceptable use
You may use RadSim for internal training and development purposes within your organization. You may not:
- Resell, sublicense, or white-label access to third parties (unless under an Enterprise agreement)
- Use the platform to generate simulations for organizations you do not represent or have authority over
- Attempt to extract, reverse engineer, or reproduce the simulation generation pipeline
- Use the platform for any purpose that violates applicable law
5. Your data
You retain ownership of your company data, employee data, and simulation session transcripts. By using RadSim, you grant us a limited license to process that data solely to deliver the service. We will never sell your data or use it to train AI models. See our Privacy Policy for full details.
You are responsible for ensuring you have appropriate authorization before entering any employee personal data into the platform. Do not enter sensitive HR data (performance improvement plans, medical records, disciplinary records) into simulation sessions.
6. Intellectual property
Rad Consultants, LLC retains all intellectual property rights to the RadSim platform, including the simulation generation pipeline, scoring system, dashboard, and all underlying software. You own your data. We own the platform.
Simulation scenarios generated for your company are licensed to you for use within your organization during an active subscription. They are not transferable and do not constitute a work-for-hire arrangement.
7. Third-party services
RadSim relies on third-party services including Anthropic (AI), Supabase (database), Firecrawl (web scraping), and Apify (job data). We are not liable for outages or data handling practices of these providers, though we select and configure them in accordance with our Privacy Policy.
8. Availability and uptime
We aim to maintain high availability but do not guarantee any specific uptime SLA for Starter or Business plans. Enterprise plans may include contractual SLAs. We perform maintenance during off-peak hours and will provide advance notice for planned downtime exceeding 1 hour.
9. Limitation of liability
To the maximum extent permitted by law, Rad Consultants, LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of RadSim. Our total liability for any claim arising from these Terms or use of the service will not exceed the fees you paid in the 3 months preceding the claim.
10. Termination
You may cancel your subscription at any time by emailing chris@radconsultants.com. We may suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation. Upon termination, your data is retained for 90 days before permanent deletion.
11. Changes to these Terms
We may update these Terms as the product evolves. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
